Terms of Service

These terms govern your use of the X Party Dresses platform. By using the site, listing an item, or buying an item, you agree to them.

Who we are

X Party Dresses is an online marketplace that connects people selling their pre-loved party dresses with people looking to buy them. We provide the platform and handle payment between buyer and seller. We are not the seller of the items listed, we do not own them, and we do not inspect them in person.

Who can use X Party Dresses

You must be at least 18 years old (or the age of majority where you live, if that is higher) and able to enter a binding contract. You agree to provide accurate information and to keep your contact and PayPal details up to date.

Listings

• Sellers are responsible for the accuracy of their listings, including photos, description, condition, size and price.
• We may review, edit, decline, or remove any listing at our discretion, for example if it breaches these terms or seems inaccurate, unsafe, or unlawful.
• Listing does not guarantee a sale.

Things you must not do

• List counterfeit, stolen, or misrepresented items, or items you do not own or have the right to sell.
• List anything unlawful, or outside the categories we permit.
• Mislead buyers, manipulate prices, or use the platform to defraud anyone.
• Attempt to take transactions “off-platform” to avoid fees after being introduced through XPD.

Suspending or closing accounts

We may suspend or close your account, temporarily or permanently, if we reasonably believe you have breached these terms, engaged in fraud or unsafe behaviour, received repeated legitimate complaints, or if we’re required to by law. Where practical we’ll tell you why. If your account is closed, any pending payout owed to you for completed, undisputed sales will still be paid out.

Fees

Sellers pay a commission on each sale, set out in the Seller Agreement. Buyers pay only the listed price plus any postage shown.

Payments

All payments are made through PayPal. XPD collects the buyer’s payment, deducts its commission, and forwards the balance to the seller as described in the Seller Agreement. XPD is a facilitator of payment, not a bank or an escrow service.

Your content

You keep ownership of the photos and text you upload, but you grant XPD a non-exclusive, royalty-free licence to display, resize and promote that content on the platform and in related marketing while your listing is active.

Our intellectual property

The X Party Dresses name, logo and branding belong to us. You may not use them without our written permission.

No warranty on items

Items are pre-loved and sold by individual sellers. XPD does not guarantee the condition, authenticity, or accuracy of any listing. To the extent permitted by law, the platform is provided “as is.”

Our liability

Nothing in these terms excludes rights you have under the Australian Consumer Law. Subject to that, XPD is not liable for the acts of buyers or sellers, for items that are not as described, or for any indirect or consequential loss. Our total liability to you for any claim is limited, to the extent permitted by law, to the fees you paid us in connection with the relevant transaction.

Indemnity

You agree to compensate XPD for any loss or claim arising from your listings, your sales or purchases, or your breach of these terms.

Resolving disputes with us

If you have a disagreement with X Party Dresses itself (rather than with another buyer or seller), please contact us first at xpd@partydresses.com.au.
